Uncontested Divorce and No Fault Divorce

Both spouses file a settlement agreement with the court. Then, the parties and their attorneys appear in court to attest to the irretrievable breakdown of their marriage. The court makes a finding whether or not there has been an irretrievable breakdown within 30 days of the hearing. The court does not take fault into account when both parties agree on the issues surrounding the separation.

Child Custody, Support and Maintenance

Before the court approves your separation agreement, it may issue temporary custody, support and maintenance orders. The court may also recommend that you modify your agreement based on your child’s best interest.
