UNCONTESTED DIVORCE LAWYERS IN MASSACHUSETTS
Uncontested Divorce in Boston Massachusetts
Lawyers Supporting Efficient, Amicable Divorce
Not every divorce is contentious. If you and your spouse agree on the division of the property, custody and support issues surrounding your divorce, you can avoid many of the financial and emotional hurdles that usually come with divorce.
Uncontested Divorce and No Fault Divorce
We can help you draft your:
- Joint petition for divorce
- Affidavit of irretrievable breakdown of marriage
- Property division agreements
- Financial statements
- Separation agreement
Both spouses file a settlement agreement with the court. Then, the parties and their attorneys appear in court to attest to the irretrievable breakdown of their marriage. The court makes a finding whether or not there has been an irretrievable breakdown within 30 days of the hearing. The court does not take fault into account when both parties agree on the issues surrounding the separation.
Child Custody, Support and Maintenance
Before the court approves your separation agreement, it may issue temporary custody, support and maintenance orders. The court may also recommend that you modify your agreement based on your child’s best interest.
Our attorneys work with you and the other party to determine what is in the best interests of your children for child custody, child support and visitation. Our goal will always be an amicable agreement that supports each parent’s right to raise their children.
Some agreements are best made with the help of a third-party mediator. If you need a neutral to help you find common ground, we can recommend mediators and represent you during the mediation process.
Occasionally, spouses run into disagreements that they didn’t know they had before beginning an uncontested divorce. If your divorce becomes a contested divorce, we can help protect your rights and support your interests.
